Option X15 reduced the Contractor’s liability for his design to ‘reasonable skill and care’. In any dispute, the burden of proof is on the Contractor to demonstrate that he used reasonable skill and care, not upon the Employer to show that he Contractor did not. Without Option X15, the Contractor’s liability for his design is strict; that is, it must be in accordance with the Works Information.
