With regard to procurement legislation, are there any exemptions from the call for competition?

Yes, numerous court rulings have indicated that there are several exemptions. To give two examples, in (199/85), the European Court of Justice ruled that derogations must be applied strictly, and that the burden of proof always lies with the organisation or party that invoked it. The Court also ruled in La Spezia 194/88R that it is illegal for an organisation to use a crisis caused by its own conduct as justification for the use of a derogation.
