# X1 indices missing from SCD1

I have just come accross an issue whereby we (main contractor) have just recently noticed that one of our subcontracts has X1 included but, no indices have been included in the contract data. Are we allowed to agree an indices between us without having to go through a deed of variation to change the contract data?

Hello,
Clause 12.3 requires changes to the subcontract to be _“agreed and confirmed in writing and signed by the Parties”_.
Accordingly, the correct way to do this is by following the provision above. You don’t need to have an all singing all dancing deed drawn up. A single piece of paper with one line to say “We agree that the Contract Data entry for X1 shall be amended as follows: [insert amendment]” - and have both parties sign this.
