# NEC Weather - Clause 61.3

I am looking for advice regarding the use of Clause 61.3 in regards to adverse weather.

Our contractor has notified a CE for adverse weather (March 2021) this is for the period of June/July 2020 some 9 months prior.

Under 61.3 you notify a CE once you become aware of it. would it be reasonable to say that this is time barred because they are notifying it 9 months after then event. Surely they became aware of the bad weather at the time and not once the weather data was received?
