The Contractor’s Key Person (site agent) has been replaced with an agency agent who does not fill me with the greatest confidence on a good day.
I know I can replace this person as per 24.1 but if I do not get anyone as good as agent 1, am I entitled to people overhead price adjustment/decrease? Agent 1 was identified at the tender and named in CD part 2.
They should have offered for acceptance the name of the alternative person before they appointed them. You would have then had to accept or not accept the alternative person. A reason for not accepting them is they are not equally qualified or experienced.
It is up to you I guess what you do about this now, but you would still be within your rights to accept or not accept even now.
