NEC ECS: What is the procedure if the Contractor has neither accepted or rejected a compensation event notification and has not instructed a quote to be submitted for the delay?

I issued a CEN at the start of our contract when we were unable to start on the agreed date in the accepted programme. NEC3 ECS Option A.  This was done some time ago.  I now want to submit a quote for the delay, can I submit my quote without a site instruction?

You have to notify the fact that they have not responded to your notification (in writing, separately from other communications) in accordance with clause 61.4. If they are silent for a further three weeks, then it is deemed accepted that it is a CE and you can go ahead and submit the quotation.
