Under an NEC Option A contract, if delay does occur and option X7 has not been selected, what are the options available to the Employer / Main Contractor when trying to recover costs?
Alex - Where you do not have a liquidated damages provision, such as X7, the entitlement is to general damages. To recover damages the party saying they have incurred them must prove the actual loss incurred and must prove that loss was caused by the delay. This can be time consuming and difficult.
