NEC3 ECC: Option B - Cancellation of Work Order booking - Lost labour resource as a result?

The Employer has made booked in works into the contract programme and due to either the Employer not progressing the works or changing the design which therefore causes a 3rd party to revoke working permits, would it be correct to assume as there is a day work rate  schedule in the BOQ, that the items for the lost labour could be utilised to recover costs for the lost programme booking due to no fault of the contractor?

Any such items would be assessed as a compensation events - which would generally be calculated using Defined Cost (shorter schedule of cost components) rather than a pre-determined rate within BofQ. The time and cost effects of the compensation event would be assessed in terms of how it has affected planned Completion.
