Procurement: Is it a legal necessity to take into account wider or additional social issues or criteria during a public procurement contract award?

Under the existing European Commission guidance, it is currently considered that such issues must not be taken into account in most circumstances. However, if there are two or more bids that are equivalent on the basis of the most economically advantageous evaluation then such issues can be considered as a way to resolve the contract award.
