If an architect fails to certify, what recourse does a contractor have?

Legal precedent indicates that action can only be taken if it can be explicitly proven that the architect has failed to certify and this is known by the employer. A diligent and ethical contractor would write to the architect and employer requesting delivery of the certificate and outlining a reasonable time-frame for complying with the demand.
