Can it be considered impossible to assert that a contractor is failing to proceed regularly and diligently?

Historically, there has been some reluctance on the part of adjudicators and courts to precisely define this. However, it is not strictly accurate to say that it is ‘impossible’ to define. In fact courts can and will now assert that contractor is failing to proceed regularly and diligently, but must take a myriad of factors into consideration, such the amount of plant and equipment on site, and the organisation of said materials.
