NEC ECC: When submitting Quality/ Technical submissions does this generally form part of the contract or is it just for evaluation purposes only

Basically as a company we have thought if we mention it in the technical submission we have qualified our tender and reduced the risk

I.e. stating no over pumping will be necessary or no rock will be encountered

I am now thinking that what is stated in our technical submission is for evaluation purposes only and is not a caveat or transfer of risk ownership. Is this the case?

You will have to review the specific Instructions for Tender (or similar document) to see the contractual standing of any documents that you return as part of your tender offer. Generally any caveats that are included in the Quality part of the submission will not amend the base contract ts&cs.
