JCT: Cost of Employment of others

Under JCT subcontract, what is the value that is due to the main contractor to employ others after termination of the contract, is there any allowance for the value left in the subcontractor package prior to termination, should this figure be offset against the cost to employ others.

Generally, the cost to complete post termination are exactly that. There is an effective final account with the subcontractor where the work he has carried out is valued in accordance with the subcontract. Deducted from that will be the amount paid and the amount it will cost to complete the work (this is always likely to be higher than the amount allowed by the subcontract).

If the termination has not been carried out correctly the answer may be significantly different.
