ECC Option C - Should the Contractor credit the client for rebates he receives?

Is the Contractor required to credit the client for any rebates he receives from his suppliers or sub-contractors?

Does it make a difference if they are agencies (supplying labour)?

Clause 52.1 makes it pretty clear that Defined Cost (under any of the options) should include “amounts at open market rates with deductions for all discounts, rebates and taxes which can be recovered”.

Buying gains or cheaper prices from subcontractors is not however the same thing. You would have to see if clause 52.1 applies to the amount in question, and consider the definition of Defined Cost which changes with the different options.
